  Yar'adua is not incapacitated - FEC

The Federal Executive Council (FEC) today resolved that President Umaru Yar'Adua was not incapable of discharging the functions of his office.

 

The resolution was pursuant to the directive of the Federal High Court, Abuja.

 

Justice Dan Abutu had directed the Council to consider, pass and publicise a resolution within fourteen days on whether President Yar'Adua is capable of discharging the functions of his office, having regard to his absence from the country since the twenty-third of November, two thousand and nine on medical ground.

         

The Minister of Justice and Attorney-General of the Federation, Mr. Michael Aondoakaa, read out the Council's resolution while briefing the State House Correspondents on the outcome of the FEC meeting.

 

Mr. Aondoakaa also explained why Vice-President Goodluck Jonathan cannot become the Acting President, noting that unless the President voluntarily transmitted a letter to the National Assembly in accordance with Section one forty-five of the Constitution, Doctor Jonathan could not be acting President.
